COUNTY COURT, PINELLAS COUNTY,
FLORIDA
TRAFFIC DIVISION
STATE OF FLORIDA,
vs.
DAVID L. RAYNAL,
Defendant.
CASE No.. 9400228630M
ORDER
THIS CAUSE was before the Court upon Defendant's written Motion
to Dismiss upon the grounds that Section 316.211 Fl. Stat. is
unconstitutional. The Court having considered the matter, finds that the
statute is overly vague and fails to give the average citizen sufficient
notice of prohibited conduct, it is therefore
ORDERED AND ADJUDGED that said motion is hereby granted.
DONE AND ORDERED in Clearwater, Pinellas County, Florida this
8th day Of December, 1995.
